WHAT ARE COOKIES?

Cookies are small text strings that the sites visited by the user send to his/her terminal (usually to the browser), where they are stored and then retransmitted to the same sites the next time the same user visits. While browsing a site, the user may also receive cookies on his terminal equipment that are sent by different sites or web servers (so-called "third parties"), on which some elements (such as, for example, images, maps, sounds, specific links to pages of other domains) present on the site he is visiting may reside.

Cookies are distinguished, on the basis of their purpose, into 'technical' and 'profiling' cookies:

  • Technical cookies are those used for the sole purpose of "carrying out the transmission of a communication over an electronic communications network, or to the extent strictly necessary for the provider of an information society service explicitly requested by the subscriber or user to provide such service" (Art. 122, para. 1 of the Personal Data Protection Code). They are not used for any further purposes and are normally installed directly by the website owner or operator. They can be divided into navigation or session cookies, which ensure normal navigation and use of the website (allowing, for example, to make a purchase or authenticate to access restricted areas); analytics cookies, assimilated to technical cookies where they are used directly by the website operator to collect information, in aggregate form, on the number of users and how they visit the site functionality cookies, which allow the user to navigate according to a set of selected criteria (e.g. language, products selected for purchase) in order to improve the service rendered to the same. Users' prior consent is not required for the installation of such cookies, while the obligation to provide information pursuant to Article 13 of the Personal Data Protection Code remains unaffected, which the site operator, if it only uses such devices, may provide in the manner it deems most appropriate.
  • Profiling cookies are those aimed at creating profiles relating to the user and are used in order to send advertising messages in line with the preferences expressed by the user while browsing the web. European and Italian legislation provides that the user must be adequately informed about their use and thus express his/her valid consent. They are referred to in Article 122 of the Personal Data Protection Code where it provides that 'the storage of information in the terminal equipment of a contracting party or user or access to information already stored is permitted only on condition that the contracting party or user has expressed his or her consent after having been informed in the simplified manner set out in Article 13(3)' (Article 122(1) of the Personal Data Protection Code).

With regard to their duration, a distinction can be made between 'session' and 'persistent' cookies:

  • Session cookies are those that are temporary and disappear from the computer when the user leaves the site visited or closes the browser. They are usually stored in the computer's cache memory.
  • Persistent cookies are those that remain on the user's computer even after the browser is closed and until they expire or the user deletes them. The expiry date is determined by the site that initiates them. They are often used to track user habits, so that when the user revisits the site, it reads the stored information and adapts to the user's preferences.

As to their authorship, a distinction can be made between 'own' and 'third-party' cookies:

  • Own cookies are those sent by the operator of the website the user is visiting.
  • Third party cookies are cookies that are sent, through the website that you are visiting, by a third party other than the operator of the website that you are visiting. These cookies are not under the control of the operator, and for more information about third party cookies, including a description of the purposes for which they are used, please visit the relevant policy pages.
